Boating Under the Influence (BUI)
It is a crime to boat under the influence of alcohol or a controlled substance in Florida. The elements of BUI are quite similar to those of DUI. However, BUI does not trigger the driver’s license suspensions triggered by DUI. The lack of a required breath test (implied consent) and the boating environment makes BUI more difficult to prove for the State than DUI.
