Possession
It is illegal to possess many items in Florida, from illegal narcotics to out of season fish. The State can attempt to prove possession either through actual possession or constructive possession. To prove constructive possession, the State must prove that the accused knew of the presence of the contraband item, knew what it was, and had the ability to exercise dominion and control over it.
