Sexual Battery

Sexual battery means oral, anal, or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual battery does not include an act done for a bona fide medical purpose. Such an act is usually committed by force, fear or threat of injury to the person. A sex act may also constitute sexual battery based on the age of the offender or victim alone. If the victim is under sixteen years old, consent does not matter and is not a defense to an offense. If the offender is 24 years old or older, consent is not a defense if the victim is under the age of 18.

Lewd & Lascivious Acts With A Minor

Any indecent or sexual activity on, involving, or surrounding a child, usually under the age of 16 is a lewd act. This lewd act is usually done for the purpose of sexual gratification. This act does not necessarily have to be sexual intercourse. The simple touching of the genitals, buttocks, breast, or pubic areas of a child for sexual gratification can be considered a lewd and lascivious act.

Exposure of Sexual Organs

It is unlawful to expose or exhibit one’s sexual organs in public or on the private premises of another, or so near to such premises as to be seen, in a vulgar or indecent manner, or to be naked in public except in any places provided or set apart for that purpose.
